If the products ordered are unavailable upon delivery, SAS Maïme Cellar immediately informs the consumer and can offer a product of equivalent quality and price.

6.5 Data archiving:

The archiving of communications, purchase orders and invoices is done on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with Article 1348 of the Civil Code. These communications, purchase orders and invoices may be produced as proof of the contract.

7. Payment

The products ordered are payable in full at the time of order and in euros. An invoice expressed in Euros including all taxes will be issued by SAS Maïme Cellar and sent to the customer at the billing address indicated. In the event of non-payment or refusal to authorize payment by accredited organizations, SAS Maime Cellar reserves the right to refuse an order.

8. Withdrawal

8.1 Reasons for withdrawal:

The buyer has a cooling-off period of fourteen (14) clear days for goods (from receipt) and for services (from acceptance of the offer) to return the product to the seller. The buyer may request an exchange or refund without penalty, subject to the condition of the goods and their packaging, with the exception of the return costs.

8.2 Withdrawal/refund procedure:

In accordance with Articles L 120-20 and following of the Consumer Code, the buyer has a withdrawal period of fourteen (14) days from the date of receipt of the products, without having to justify the reasons or pay penalties except, where appropriate, the cost of return. Complaints are only accepted within fourteen (14) days of receipt of the goods. In order to cancel the order within the fourteen (14) working day retraction period, the buyer must return the goods in their original box by notifying SAS Maïme Cellar by mail or by email to maime.terre@wanadoo.fr and by returning the retraction form. SAS Maïme Cellar will not accept any returns one (l) month after the goods have been shipped. Refund of payment will be made as soon as possible after receipt of the returned merchandise.

9. Delivery

9.1 Place of delivery

Delivery in metropolitan France only. For any shipment in Europe or in the World, please contact us.

9.2 Delivery times and costs

The delivery time of 5 working days (metropolitan France) may vary. It depends on the delivery service provider (Transport Schenker, Joyau, Alloin or other). SAS Maïme Cellar is in no way responsible for delays. By express agreement, SAS Maïme Cellar reserves the ownership of the goods delivered until full payment of the invoice, the customer having however as soon as it is available the custody of the products that are the subject of the invoice. Shipping costs: fifteen (15) euros for any purchase less than two hundred (200) euros. Offered for any purchase equal to or greater than two hundred (200) euros. For any shipment in Europe, please contact us. Shipping in cartons of twelve (12) or six (6) bottles.

9.3 Delivery delay:

A delay, even important, can cause neither refusal of delivery, nor action for damages of any kind.

9.4 Terms of delivery:

Our shipments are insured by external service providers, in particular Transport Schenker, Joyau, Alloin or other.

10.1 Data Collection and Use

The collection of nominative data, their use for the processing of orders and the creation of customer files and their distribution to third parties responsible for the execution and payment of orders, is subject to the consent of the person concerned. 11. Management of disputes and contact

11.1. Failure to deliver Procedure

At the time of delivery, in case of missing or damaged packages, reservations must be made on the carrier's delivery receipt and be confirmed by registered letter within three (3) working days to the delivering carrier with a copy for the sender at the following address: SAS Maïme Cellar RDN 7 83460 Les Arcs sur Argens. Our guarantee is strictly limited to the replacement within a normal period of time or to the reimbursement at our discretion of goods found to be defective, after examination by us. The eventual replacement can in no case justify a delay or a refusal to pay our invoices. Only the value of the goods found to be defective may be retained. Any deduction made from our invoices for any reason whatsoever shall be deductible from our turnover and shall lead to a proportional reduction in the amount of VAT. 11.2. Litigation

If the customer is a company and a dispute arises, the competent court to hear this dispute will be the court of Draguignan.

If the client is a natural person and a dispute arises, the client may bring the matter before the court of his choice under the Code of Civil Procedure.

12. Guarantees

12.1 Statutory guarantees

All products supplied by the professional seller benefit from the legal guarantee of conformity provided for in articles L 211-4 to L 211-14 of the Consumer Code and the legal guarantee of hidden defects provided for in articles 1641 to 1649 of the Civil Code. Under these guarantees, the professional seller undertakes, at the choice of the consumer, to reimburse or exchange the goods or products that do not correspond to the order. Article L211-4 of the French Consumer Code: The seller is required to deliver a good that conforms to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects of conformity resulting from the packaging. Article L211-5 French Consumer Code: To be in conformity with the contract, the goods must: be fit for the use usually expected of a similar good with the qualities that a buyer can legitimately expect, particularly in advertising or labelling brought to the seller's attention and which the latter has accepted. Article 1641 Civil Code: The seller is bound by the warranty because of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would have paid a lower price for it, if he had known about them.

12.2 Law applicable to warranties

The French law applicable to the contract by virtue of Article 11 of the GTC may not have the effect of depriving a consumer residing in another Member State of the provisions on guarantees granted to him by his national law pursuant to Directive No 99/44/EC of 25 May 1999 on the sale of consumer goods and associated guarantees.

INFORMATIONS CONCERNANT L’EXERCICE DU DROIT DE RÉTRACTATION

Droit de rétractation

Vous avez le droit de vous rétracter du présent contrat sans donner de motif dans un délai de quatorze jours. Le délai de rétractation expire quatorze jours après le jour où vous-même, ou un tiers autre que le transporteur et désigné par vous, prend physiquement possession du dernier bien. Pour exercer le droit de rétractation, vous devez nous notifier à notre adresse postale ou électronique votre décision de rétractation du présent contrat au moyen d’une déclaration dénuée d’ambiguïté (par exemple, lettre envoyée par la poste, télécopie ou courrier électronique). Vous pouvez utiliser le modèle de formulaire de rétractation mais ce n’est pas obligatoire. Pour que le délai de rétractation soit respecté, il suffit que vous transmettiez votre communication relative à l’exercice du droit de rétractation avant l’expiration du délai de rétractation.

Effets de rétractation

En cas de rétractation de votre part du présent contrat, nous vous rembourserons tous les paiements reçus de vous, y compris les frais de livraison (à l’exception des frais supplémentaires découlant du fait que vous avez choisi, le cas échéant, un mode de livraison autre que le mode moins coûteux de livraison standard proposé par nous) sans retard excessif et, en tout état de cause, au plus tard quatorze jours à compter du jour où nous sommes informés de votre décision de rétractation du présent contrat. Nous procéderons au remboursement au choix par chèque ou virement bancaire; en tout état de cause, ce remboursement n’occasionnera pas de frais pour vous. Nous pouvons différer le remboursement jusqu’à ce que nous ayons reçu le bien ou jusqu’à ce que vous ayez fourni une preuve d’expédition du bien, la date retenue étant celle du premier de ces faits.
